Terms and Conditions for DateMe

Welcome to DateMe! These Terms and Conditions ("Terms") govern your access to and use of the DateMe mobile application ("the App"), provided by Infisutra Software Solutions Pvt. Ltd. ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.
You must be at least **15 years of age** to create an account and use the DateMe App. By using the App, you represent and warrant that you are at least 15 years old and have the legal capacity to enter into these Terms.
You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

DateMe is committed to fostering a safe, respectful, and positive environment for all users. You agree to:
- Respect Others: Treat all users with respect and kindness. Harassment, discrimination, hate speech, bullying, or any form of abusive behavior is strictly prohibited.
- No Spam or Misuse: You will not use the App for any unauthorized commercial purposes, spamming, sending unsolicited messages, or any other form of misuse.
- Accurate Information: Provide accurate and truthful information in your profile. Misrepresenting yourself or your intentions is not allowed.
- Legal Use: Use the App only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations.
- Prohibited Content: You will not post, upload, or transmit any content that is illegal, defamatory, obscene, pornographic, infringing on intellectual property rights, or harmful to minors.
- No Impersonation: You will not impersonate any person or entity.
We reserve the right to investigate and/or terminate your account without a refund if you violate these Terms or misuse the App.
- Matching Algorithms: DateMe uses both standard dating algorithms and astrological algorithms based on your provided birth details (Name, DOB, POB) and interests to suggest compatible matches.
- Encrypted Chat: All in-app messages are encrypted for your privacy and security.
- "Interested In" Options: The App allows users to specify their interest in Marriage, Relationship, Friends, or Open to Anything, facilitating diverse connections.
- Subscription Tiers (Premium Features): DateMe offers various subscription tiers to enhance your dating experience:
- Free: Limited features to get started.
- Blaze: Includes Unlimited Swipes, Astro-Aligned Matches, Encrypted & Safe Messaging (with auto-delete), Unlimited Profile Views, NO Ads, and Enhanced Profile Recommendations.
- Gold: Includes everything in Blaze, PLUS Nearby Profiles by Map, Undo Missed Match, and Premium Match Insights (deeper compatibility analysis).
- Premium: Includes everything in Gold, PLUS Expanded Premium Match Insights (comprehensive compatibility reports and deeper astrological breakdowns), and Travel Mode (set your location anywhere to match before you arrive).
DateMe employs a fair and comprehensive process to handle reported profiles and ensure the safety of our community:
- For Non-Subscription Users: If a non-subscription user is reported by a significant number of other users, our system will directly block their account. The account is then moved to a manual monitoring queue, where our moderation team reviews the reasons provided by the reporting users.
- For Subscription-Based Users: If a subscription-based user is reported by multiple users, their profile is immediately flagged for manual review. However, their account will **not be blocked immediately**. Instead, a warning will be displayed on their User Dashboard indicating that their profile is under review due to multiple reports.
- Manual Review Process: During manual review, our team meticulously examines the reasons selected by the reporters. We categorize reported reasons as "critical," "warning," or "red-flag" based on their severity.
- Communication with Reported Users: In some cases, especially for critical reports or when more information is needed, we may send an email to the reported user seeking clarification or a response regarding the allegations.
- Action Against False Reports: We are committed to a fair process. If, during our manual review, we find that a report was made maliciously or falsely, we will investigate the reporters. If a user is found to have repeatedly made false reports, we will take appropriate actions, which may include blocking their account.
- System Actions Based on Report Severity: Our system takes actions proportionate to the severity of the reported reasons. For "red-flag" or critical reports (e.g., CSAE, severe harassment), immediate and permanent blocking may occur regardless of subscription status. For "warning" level reports, actions may include temporary suspension, feature restrictions, or mandatory re-verification.
DateMe offers various auto-renewing subscription plans. All subscriptions and in-app purchases are processed through and governed by the billing systems of the Google Play Store (for Android) and the Apple App Store (for iOS).
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
- Cancellation: You must cancel your subscription directly through your Google Play Store or Apple App Store account settings. DateMe does not directly manage subscription cancellations.
- Refunds: All refund requests are subject to the refund policies of the Google Play Store or Apple App Store, respectively. Please refer to our dedicated Refund Policy for detailed instructions on how to request a refund from the app stores.
All content and materials available on the App, including text, graphics, logos, icons, images, and software, are the property of Infisutra Software Solutions Pvt. Ltd. or its licensors and are protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any content from the App without our express written permission.
The DateMe App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's operation or the information, content, or materials included therein.
We do not guarantee the accuracy, completeness, or reliability of any user profiles or astrological insights generated by the App's algorithms. While we strive to provide the best matches, the outcome of any relationship is solely dependent on the individuals involved.
To the fullest extent permitted by law, Infisutra Software Solutions Pvt. Ltd. will not be liable for any damages of any kind arising from the use of the App, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease. Any refunds for terminated accounts due to breach of terms will be subject to the policies of Google Play Store or Apple App Store, as detailed in our Refund Policy. We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
